Terms and Conditions Agreement

These Terms and Conditions ("Terms") govern the relationship between Moyana IT Consulting ("we", "us", "our") and the client or user ("you", "your") regarding the use of our website, www.moyana.tech, and the provision of our IT support services. By accessing our services, you agree to be bound by these Terms.

1. Scope of Services
We provide IT support, training and related consulting services as described in your specific service plan or proposal. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

2. Information Collection and Privacy
As part of our business operations, we collect basic contact information (e.g., name, email, phone number, billing information) necessary to provide services and manage your account.
Data Use: Your information is used strictly for service delivery, billing, and communication.

3. User Responsibilities
To receive effective IT support, you agree to:
Provide accurate and up-to-date contact information.
Grant necessary access to systems, hardware, or staff required for troubleshooting.
Comply with all applicable laws and our Acceptable Use Policy, which prohibits using our services for any illegal or harmful activities, such as transmitting viruses or attempting unauthorized access.

4. Payment and Billing
Fees: You agree to pay all fees associated with your chosen service plan.
Late Payments: We reserve the right to suspend services if payments are not made by the due date specified on your invoice.

5. Intellectual Property
All content, software, and proprietary tools used by Moyana IT Consulting remain exclusive property of rightful owner. You are granted a limited, non-exclusive license to use these materials solely for the duration of your service agreement.

6. Limitation of Liability
To the maximum extent permitted by law, Moyana IT Consulting shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits) arising from the use or inability to use our services. Our total liability is limited to the amount paid by you for the specific service in question.

7. Termination
Either party may terminate this agreement within 7 days' written notice. We may terminate or suspend your access immediately if you breach these Terms or fail to pay outstanding fees.

8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of Alberta, without regard to its conflict of law principles.

9. Changes to Terms
We may update these Terms from time to time. The "Effective Date" at the top will indicate when changes were last made. Continued use of our services after updates constitutes acceptance of the new Terms.
